
Over the last couple of months I explained how the new Corporate Manslaughter & Corporate Homicide Act, which comes into force on 6th April, could affect you. Now that the festive season is over this is a good time to reflect on how you are going to address the implications of the new law.
If you are the person responsible for managing work-related road safety or if it is part of your job specification, this is quite an undertaking. You will need to carry out a thorough risk assessment of how your company’s driving affects employees and other road users. Then you will need to come up with effective management processes to manage the risk, bearing in mind that you will need to regularly review your risk assessment to ensure it is still valid.
There are outside agencies that will provide guidelines on risk assessment and provide licence, insurance and MoT checking, together with online driver profiling and in-car training. Some companies assume that this approach will cover their minimum duty of care. But it will not keep them continuously up-to-date on how their drivers are performing on the road so that they can effectively manage the risk at all times.
If you are serious about managing your company’s work-related road safety, you should be looking at a solution that goes much further than the minimum. You should be looking at one that is not a mere sticking plaster approach, but one that demonstrates your company’s genuine commitment to the health and safety of its employees as well as to other road users.
